Joint Statement on the second CEDAW review

20 June 2014; Paris, Taipei: In light of the international review of Taiwan's second national report on its compliance with the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), our organizations earnestly appeal to the government of Taiwan to establish an independent reviewing mechanism and legal framework to ensure that the rights enshrined in the CEDAW are respected in Taiwan.

The international experts who participated in the review of Taiwan's first CEDAW report in 2009 recommended that the government of Taiwan should establish a national human rights institution to facilitate access to legal redress for victims of discrimination against women. They also called for all legislation to be in line with the provisions of CEDAW and to be reviewed for possible discrimination. Following the March 2013 review of the initial reports of the Government of Taiwan on the  implementation of International Covenant on Civil and Political Rights (ICCPR) and International Covenant on Economic, Social and Cultural Rights (ICESCR), the 10 international independent experts who conducted the review also adopted a list of concluding observations and recommendations for the government of Taiwan, including the promotion of gender equality and the establishment of an independent national human rights commission. Unfortunately, the government has failed to act on these recommendations, that are all the more relevant today as discrimination against women continues to be a major problem in Taiwan.  Numerous Taiwanese organizations working on human rights and gender equality, including TAHR, have presented alternative reports to the international experts reviewing Taiwan's national report on the CEDAW, which clearly outline the ongoing challenges to gender equality and women's rights in Taiwan. Victims of these human rights violations still have little or no access to legal redress or justice. We therefore insist that the recommendations put forth in 2009 and 2013 by international experts for Taiwan to establish a national human rights institution are more important than ever and must be immediately implemented.

FIDH and TAHR urge the government of Taiwan to:

l  fulfill its responsibilities outlined in the CEDAW, ICCPR, and ICESCR, and define a timeline for its ratification of the other international human rights treaties;

l  establish an independent National Human Rights Institution that meets the requirements of independence and autonomy set out in the Paris Principles; and

l  consult with NGOs to establish a monitoring mechanism for the implementation of the concluding observations and recommendations that emerge from the international reviews of Taiwan's reports on the international human rights covenants.
