【聯合聲明】聲援泰國和平民主運動

作為橫跨亞洲的60個組織，我們聲援在泰國政府打壓下仍不屈不撓地推進基本人權與民主改革的和平民主運動。泰國政府應履行《聯合國公民與政治公約》所課予的義務，尊重並保護人民的表意自由與和平集會權。我們強烈主張2020年10月15日所宣布的「緊急狀態」牴觸了國際人權標準，不具正當性、必要性與衡平性。我們譴責以「國家安全」為託辭箝制和平抗爭，以及將該社運與其領袖描繪為國安威脅的圖謀。我們還要譴責警察的暴行，包括在2020年10月16日向含有高中生與大專生的和平抗爭隊伍動用水砲車。此舉不符合人權高專辦(OHCHR)所言明—水砲車只有在「相當可能導致生命喪失、重傷害、廣泛性財產損壞的嚴重公共失序」之際被建議使用—的指導原則。
一連串針對人權捍衛者的緝捕和濫行起訴，欠缺正當基礎；除了為嚇阻運動並鼓吹報復，別無其他目的。被逮捕的抗爭者與領導者應被即刻且無條件的釋放。我們同樣要譴責威嚇或清算曾在抗爭地點打卡、自拍或在社群平台上發表抗爭貼文之社媒用戶的相關措施。在2020年10月19日，數位資訊部的部長宣佈他們將偵查30萬餘據稱觸犯緊急命令之社媒帳戶的URL位址。
此外，我們極為掛慮欲促使Prachatai, the Standard, The Reporters, and Voice TV等媒體基於報導抗爭而被偵查的企圖，以及防止他們報導這類活動的伎倆。媒體所扮演的角色，在這等時期與平時一樣至關重要，政府有義務保障媒體之自由與獨立性。資訊的近用權是貫徹人民表意自由不可或缺的一部份。我們意識到該區域的其他政府同樣以這類手段抑止社會運動。這類手段違反了國際人權標準，在任何公平公正的國家沒有存留的餘地。
我們呼籲泰國政府恪守對表意與和平集會自由的尊重與保障。我們敦促該政府:
避免追加施行或宣布任何命令和政策，包含依緊急命令，箝制人民行使基本權利；
立即且無條件的釋放所有被逮捕的人權捍衛者與抗爭者，撤回所有對他們的起訴，並避免追增任何逮捕、威脅與恫嚇的行為；
終止對抗爭者的警察暴力；
尊重兒童與少年，就與他們切身的事務，安全而和平地表達意見的權利；
審查或廢止刑事法律中，諸如誹謗與煽惑等作為威懾與報復工具的罪刑；
尊重並支持媒體獨立與自由，包含容許地方與國際記者不受干涉或清算的運作；以及
採行實質措施解決民主運動所指出的結構性暴力。
我們呼籲國際社會聲援泰國的民主運動以及亞洲所有促進政府問責與人權保障的社運。
